Terms of Service

These Terms of Service (the Terms) are an agreement between you and the Provider named in section 16 about your use of htmlkin.io.

Please read them before you publish anything. By using the Service you accept these Terms in full, as described in section 3.

1. Definitions

2. What the Service does

2.1. The Provider publishes and hosts your Sites and makes them available over the internet at a unique address, with HTTPS.

2.2. The current description of features, plans and payment methods is published on the website of the Service and in the Dashboard.

2.3. The Service is provided remotely, over the internet, and operates automatically.

2.4. The set of features available to you — the number of sites, custom domains, PIN protection, lead forms and the REST API and MCP server request rate — depends on the plan you choose. Prices may change, including through promotions and discounts; a change never affects a period you have already paid for.

3. How the agreement is formed

3.1. The agreement takes effect as soon as you do any of the following: sign up for the Service, publish a Site (including anonymously or through the API or MCP), or pay for a plan.

3.2. By doing so you confirm that you have read these Terms and the Privacy Policy and that you accept them in full.

3.3. For paid plans, the agreement for the paid period takes effect when the payment is received.

3.4. You confirm that you have the legal capacity to enter into this agreement. If you accept these Terms on behalf of an organisation, you confirm that you are authorised to do so.

4. Plans, payment and renewal

4.1. Paid plans are sold as a subscription for the billing period you choose — one month or twelve months. Prices are shown in US dollars and are final: the amount shown on the pricing page is the amount charged.

4.2. Payments are processed by Stripe, which is responsible for handling and protecting your payment details. The Service never receives or stores card numbers, card details or other payment credentials.

4.3. By subscribing you authorise recurring charges for each following billing period to the payment method you provided, until the subscription is cancelled. Renewal is charged on the same day of the month on which the subscription started; if a month has no such day, on its last day.

4.4. The Service may offer a free trial of a paid plan once per account. Starting the trial requires a payment card, which is not charged during the trial. When the trial ends, the subscription starts and the first charge is made, unless you cancel before the end of the trial.

4.5. You can cancel the subscription at any time in the Dashboard. After cancellation the period you have already paid for runs to its end, and no further charges are made.

4.6. Changing the plan or the billing period starts a new subscription and ends the current one. The unused part of the current period is not refunded.

4.7. If a renewal payment fails, the Provider may retry it and may limit paid features until the payment succeeds.

5. Refunds

5.1. If the Service did not work as described, you may ask for a refund within 14 days of the payment.

5.2. To do that, write to support@htmlkin.io from the email address of your account and tell us the date of the payment and what went wrong. We reply within 24 hours.

5.3. If the request meets these conditions, the Provider refunds the payment or provides the service again within 3 business days.

5.4. Refunds are returned to the payment method used for the original payment.

5.5. Where mandatory consumer law of your country of residence gives you broader rights — for example a statutory right to withdraw from a distance contract — those rights apply in addition to this section.

6. How the Provider handles your content

6.1. The Provider supplies the technical means to store and deliver your Sites and acts as a hosting intermediary, not as the author, editor or publisher of what you publish.

6.2. You decide what a Site contains, you upload it and you decide who gets the link. The Provider does not initiate publication, does not choose the recipients, does not moderate Sites before they go live and does not check whether their content is lawful, accurate, safe or up to date.

6.3. Technical processing of a Site — storage, caching, delivery over the internet, adding a promotional banner on free plans, security headers and other technical elements — does not mean that the Provider has reviewed, approved, edited or taken responsibility for its content.

6.4. Published Sites are open to search engine indexing by default and may appear in the public Examples section of the website with a thumbnail of the home page, its address and the date of publication. You can turn this off at any time with the “Available to search engines” setting in the Dashboard. Sites protected with a PIN are never indexed and never shown in that section. The Provider may leave any Site out of the Examples section at its discretion; being shown there does not mean the Site was reviewed or approved.

7. What you must not publish

7.1. You must not publish material that:

7.2. You must also not:

8. Suspension, removal and complaints

8.1. The Provider may, without prior notice, refuse to publish a Site, restrict access to it, remove it or block an account or an API key if it finds a breach of these Terms, receives a notice from a rights holder, a complaint from a third party, a lawful request from a competent authority, or any other indication that the content may be unlawful.

8.2. Send notices about a published Site to info@htmlkin.io. Please include the exact URL, a description of the problem, evidence of your rights or legitimate interest, and how to reach you. The Provider may ask for more detail if the notice does not identify the Site or the alleged breach.

8.3. If your Site was removed or your account was blocked and you believe this was a mistake, write to the same address; the Provider will review the decision.

9. Your obligations

9.1. You use the Service in accordance with these Terms and with the law that applies to you.

9.2. You are fully responsible for what you publish, for whether publishing it is lawful, for the consequences of publication and for respecting the rights of others.

9.3. You keep your own copies of the source files of your Sites, and you keep your account credentials and API keys safe.

9.4. You confirm that you hold all rights, consents and permissions needed to publish what you upload and to make it available at the addresses the Service issues.

9.5. You deal with claims, demands, lawsuits and enquiries about your Sites yourself, and you compensate the Provider for losses, costs, fines and other damage caused by your breach of these Terms, of the law or of the rights of others, to the extent the applicable law allows.

9.6. You stop a breach as soon as the Provider asks you to — by removing or changing the Site where you can, or by not obstructing the Provider in restricting access to it or removing it.

10. Intellectual property

10.1. The Service, its source code, design and trademarks belong to the Provider.

10.2. The content of published Sites belongs to you or to its rights holders. By publishing a Site you confirm that you hold the rights to its content.

10.3. For as long as a Site is published, you grant the Provider a non-exclusive, royalty-free licence to store, technically reproduce, cache, make available to the public and otherwise technically process its content to the extent needed to run the Service.

10.4. This licence transfers no ownership and gives the Provider no right to use your content outside providing the Service, except where these Terms or the law say otherwise.

11. Personal data

11.1. The Provider processes personal data as described in the Privacy Policy, which forms part of these Terms.

11.2. For the content you publish you are the one who decides what personal data it contains; the Provider processes it only as part of hosting your Site.

12. Availability, storage and limits

12.1. The Service is provided “as is”. The Provider does not guarantee uninterrupted operation and may suspend access for maintenance.

12.2. Anonymous Sites are deleted automatically 24 hours after publication.

12.3. Sites of signed-up Users are stored within the limits of the current plan. On the free plan a Site lives as long as people visit it: after 30 days without visits it is archived, and for another 30 days it can be restored from the Dashboard. When a subscription ends, access to Sites above the free plan limit may be restricted.

12.4. PIN protection is a light access restriction (a 4-digit code) and is not meant to protect confidential data. The Provider is not responsible for the disclosure of content protected only by a PIN.

13. Liability

13.1. The Provider is not responsible for Sites published by Users, for the consequences of their publication, viewing or use by others, for their indexing by search engines, or for their copying, distribution or blocking, unless mandatory law says otherwise.

13.2. To the extent the applicable law allows, the Provider is not liable for lost profit, lost data or indirect damage, and its total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim arose.

13.3. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for intent, gross negligence or harm to life and health, and nothing limits the mandatory rights of consumers.

14. Changes to these Terms

14.1. These Terms apply from the moment they are published on the website and until the Provider withdraws or changes them.

14.2. The Provider may change them. A new version takes effect when it is published at https://htmlkin.io/en/public-offer. If a change materially affects a paid subscription, the Provider notifies subscribers by email in advance. Continuing to use the Service after the change means you accept it.

15. Disputes and governing law

15.1. Before going to court, please write to info@htmlkin.io. The Provider reviews the claim and replies within 3 business days.

15.2. These Terms are governed by the law of the Provider’s place of residence, and disputes that cannot be settled out of court are heard at the Provider’s location — except that, if you are a consumer, you keep the protection of the mandatory law of your country of residence and may bring a claim in its courts.

15.3. If a provision of these Terms is found invalid, the rest stays in force.
